Title VI - Civil Rights Act

In accordance with Title VI of the Civil Rights Act of 1964, HARTransit operates its programs without regard to race, color and national origin. HARTransit has an established process in place to deal with complaints of discrimination. Title VI Complaint Procedures

The procedures below apply to all complaints filed under Title VI of the Civil Rights Act of 1964, relating to any program or activity administered by HARTransit or any sub recipients, consultants and /or contractors. Intimidation or retaliation of any kind is prohibited by law.
 
These procedures do not deny the right of the complainant to file formal complaints with other state or federal agencies, or to seek private counsel for complaints alleging discrimination.
 
Every effort will be made to obtain early resolution of complaints at the lowest level possible. The option of informal mediation meeting(s) between affected parties and the Title VI Coordinator – currently the CEO – may be utilized for resolution at any stage of the process.
 
The Title VI Coordinator will make every effort to pursue a resolution to the complaint.
 
Any Individual, group of individuals or entity that believes they have been subjected to discrimination may file a written complaint with HARTransit’s Title VI Coordinator. A formal complaint must be filed within 180 calendar days of the alleged event or when the complainant became aware of the alleged discrimination.

 

• Complaints of this nature must be in writing and signed by the complainant(s).
 
•They must Include the date that the act of discrimination took place. That is, the date that the complainant became aware that the discrimination took place, the date on which the discriminatory conduct ended, or the latest instance of the discriminatory conduct.
 
• Complaints should present a detailed description of the incident or incidences, including the names and job titles of those HARTransit employees involved.
 
• A complaint form will be sent to those alleging complaints of discrimination via e-mail, fax or telephone. A signed, original form or comparable narrative must be completed and returned to HARTransit.
 
Once the complaint is received, HARTransit will review it and begin an investigation. HARTransit may take up to 30 days to investigate the complaint. If more information is required, HARTransit may contact the complainant. If that information is not received, or the complainant does not respond after repeated inquiries, the case may be administratively closed.
 
After the investigation is complete, a letter with the results of the investigation will be issued to the complainant.
